About Us and User Requirements

"Khronotech LLC", "Khronotech", "We", or "Us" refers to Khronotech LLC, a company incorporated under the laws of the USA, with our registered office at 79 Alexander Street, APT 1234, Yonkers, NY, USA.

As a developer and publisher, Khronotech specializes in creating games and mobile game applications accessible through various app stores, including but not limited to the Apple Application Store and Google Play Store (referred to collectively as "App Stores"). Our offerings are collectively known as "Games".

To engage with our Games, you must adhere to the following criteria:

Age Requirement:
- You should be at least 13 years old. However, if you are in the European Economic Area (the "EEA"), you must be over 16, and if in Brazil, over 18 years of age.
- If you do not meet these age requirements, you are prohibited from creating an account, using any of our Games, or submitting personal information within a Game or to Khronotech. This includes details like your name, address, phone number, or email address. An exception is made if a Khronotech Game includes an age-gate mechanism that collects age information and permits users under the specified age limits to access the Game.
Previous Bans:
- You should not have been previously banned from playing any of our Games, unless such a ban has been officially reversed by us.

Your Privacy and Additional Terms

Your Privacy: Our Privacy Policy outlines the methods of how we collect, store, use, disclose, and manage your personal information in connection with your download or use of our Games. It also details your rights and choices regarding your information. By downloading or using our Games, you acknowledge and agree to the terms outlined in our Privacy Policy. If you are not comfortable with Khronotech's practices as described in our Privacy Policy, you should not download or use our Games.

Additional Terms: Your use of our Games is also subject to specific additional terms:

Application Stores:
- The application stores and platforms from which you download our Games, such as Apple's App Store or Google Play Store, have their own terms and conditions. These terms govern your relationship with these App Stores and platforms and are separate from Khronotech's Terms.
Third-Party Services:
- Our Games may incorporate third-party applications, such as leaderboards or game networks, to enhance your gaming experience (“Third Party Services”). When you use features provided by these Third Party Services within our Games, you are also subject to the terms and policies of these third parties, including their privacy policies.

Please be aware that these additional terms are an integral part of our Terms of Service and should be read in conjunction with the main body of our Terms.

System and Equipment Requirements for Game Access

To fully experience our Games, you will need a compatible smartphone or tablet running iOS or Android. The specific requirements for each Game, including the minimum memory and operating system version, will be detailed in the Game's description. Keep in mind that updates to our Games may necessitate the most recent version of your device's operating system and the latest updates for any relevant third-party software.

While we at Khronotech are responsible for creating and maintaining the Games, the responsibility of providing the necessary hardware falls on you. This includes devices like computers, phones, and tablets. Additionally, you will be responsible for all related costs, such as internet access, connections to App Stores, and any data or cellular charges that may apply when downloading and engaging with our Games.

Game Licensing and User Rights

The Games are licensed to you; they are not sold. Khronotech and its licensors, where applicable, retain all rights, including but not limited to copyright, trademark, patent, and other intellectual property rights globally, as well as adherence to applicable laws, rules, or regulations related to the Games. Except for the limited license granted to you, all other rights are reserved. You do not acquire any intellectual property rights in or related to the Games, other than the right to use them in line with these Terms.

Under these Terms, you are permitted to:

Download a copy of the Game onto your device and use it for personal purposes.
Copy the Game for downloading, installing, and executing the number authorized by the download site on a mobile device you own or control.
Receive and use any free supplementary software updates provided by us ("License").

Restrictions on Use

You agree to the following:

The Game is for personal use only. You will not use it for commercial purposes such as playing the Game in commercial establishments, using it for esports or group competitions without Khronotech's consent, or any commercial exploitation.
You will not license, sell, rent, lease, transfer, assign, distribute, host, or commercially exploit any Game.
You will not modify, translate, adapt, merge, create derivative works from, disassemble, decompile, reverse compile or reverse engineer any part of the Games, except as allowed by law.
You will not use any Game to develop a similar or competitive service or application.
Except as explicitly stated in these Terms, you may not copy, reproduce, distribute, republish, download, display, post, or transmit any part of the Games in any form.
You will comply with all applicable laws, including export and import regulations related to the technology used in the Games.

Guidelines for Appropriate Use of Our Games

When using our Games, you are required to adhere to the following guidelines to ensure a safe and enjoyable experience for all users:

Prohibited Actions:
- Do not upload or distribute software that is harmful, such as computer viruses, worms, malicious code, or anything designed to damage or alter computer systems or data.
- Avoid transmitting material that is defamatory, false, misleading, threatening, offensive, or otherwise objectionable in connection with your use of the Game.
- Refrain from collecting other users' information, including email addresses, without their consent, for example through harvesting bots, robots, spiders, or scrapers.
- Do not engage in actions that disrupt, burden, impair, or interfere with servers or networks connected to the Games, such as denial of service attacks.
- Avoid attempting unauthorized access to the Game or related servers or networks, such as through password mining.
Respect Intellectual Property:
- Ensure that your use of the Game does not infringe on our intellectual property rights or those of any third party, including the submission of any material.
Legal and Respectful Usage:
- Use the Game lawfully and in a manner that is consistent with these terms, without engaging in behavior that could harm minors or disrupt the enjoyment of other users.
- Avoid actions that could damage, disable, overburden, or impair our systems or security, or interfere with other users' experiences.
No Spam or Unauthorized Advertising:
- Refrain from uploading or distributing unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any similar forms of duplicative or unsolicited messages, whether commercial or otherwise.

Remember, these guidelines are in place to protect the integrity of our Games and the safety of our gaming community. Non-compliance with these rules may lead to suspension or termination of your access to our Games.

Limitations and Modifications of Service

Khronotech continuously works on improving and updating our Games for better performance, enhanced functionality, and to keep pace with operating system changes and security requirements. Occasionally, we may need to ask you to update the Game for these reasons. All future releases, updates, and additional functionalities of any Game (including in-app purchases, new levels, and gameplay enhancements) fall under these Terms, unless specified otherwise in the terms associated with such updates.

If you decide not to install updates or disable automatic updates, you may experience limited Game functionality. Khronotech is not liable for any harm to your device or digital content that could have been prevented by installing these updates.

We reserve the right to suspend, discontinue, or modify any Game or its parts at any time, with or without notice. Discontinuation may not affect Games already downloaded by you, but these Games may no longer receive support or updates, and access to certain services may be revoked. Unless required by applicable law, Khronotech is not obligated to offer refunds, benefits, or compensation in connection with the discontinued elements of the Games, including subscriptions or previously acquired Virtual Items.

In accordance with legal allowances, Khronotech may limit, suspend, terminate, modify, or delete Games or your access to them, including in-game content and tools. We may also delay or remove hosted content and are not required to provide compensation for any resulting losses.

User Content Responsibilities and Rights

When you utilize features in our Games that allow you to upload, distribute, or interact with other users through User Content, you must adhere to our Acceptable Use Policy as mentioned earlier.

Your Responsibility for User Content:

You bear full responsibility for your User Content.
You assume all risks related to the use of your User Content, including its reliability, completeness, or usefulness to others, or any risk arising from the disclosure of information that identifies you or any third party.
You must not claim or suggest that your User Content is provided, sponsored, or endorsed by Khronotech.
Khronotech does not guarantee the backup of any User Content, and it may be deleted at any time. We advise you to maintain your own backups of your User Content.

Rights Granted to Khronotech:

By posting or uploading User Content to our Games, you grant Khronotech:
- An irrevocable, non-exclusive, royalty-free, worldwide license with rights to sublicense. This license allows us to reproduce, distribute, publicly display, perform, create derivative works from, incorporate into other works, and otherwise use your User Content in any Game and for the promotion of the Game indefinitely.
- A similar non-exclusive, royalty-free license is also granted to our partners and other users to interact with your User Content in accordance with the Game's functionality, including sublicensing rights.

Disclosure of User Content and Identity:

In accordance with applicable laws, we may disclose your identity to third parties who claim that your User Content infringes their intellectual property rights or their right to privacy.
We may also disclose your User Content to third parties or governmental bodies if legally required to do so.

Please remember that your contributions to the Game through User Content are important, and you should be mindful of the implications of sharing your content and personal information in an online community.

Feedback, Content Monitoring, and Termination of Service

Feedback to Khronotech:

Any feedback or suggestions you provide to Khronotech, whether through a feature request, directly to us, or via an App Store, will be considered non-confidential and non-proprietary.
Khronotech has the freedom to use such feedback unrestrictedly, without any obligation to compensate you or any third party.

Monitoring and Enforcement of User Content:

Our Games may include User Content from various users. We do not endorse, verify, or approve User Content and are not obligated to monitor the Game for inappropriate or illegal content.
At our discretion, we may review, remove, modify, or refuse to post any User Content at any time, with or without notice, for any reason.
If your User Content violates these Terms, including our Acceptable Use Policy, we reserve the right to disable your posting capabilities and may terminate your access to the Game.

Reporting Misuse:

If you encounter another user violating these Terms or misusing our Games, please report it via the "Help Shift" link.

Term and Termination:

These Terms are effective for as long as you download and/or use the Game, subject to any modifications.
If you breach these Terms or any other applicable terms, we may take actions including suspending your access or terminating your rights to use the Game. This applies to violations of the Acceptable Use Policy or infringements on third-party intellectual property rights. Such actions might also constitute legal violations.
Disruption or interference with a Game, including manipulating its operation, is a breach of our Terms and may lead to legal consequences.

Consequences of Termination:

Upon termination of your rights:
- You must cease accessing the Game and delete it from your devices.
- Any in-game progress and related data will be lost and are non-recoverable.
- Your User Content may be removed from our live databases.

Remember, these measures are necessary to maintain the integrity and quality of our gaming environment and to protect the rights of all users and third parties.

Your Obligations and Liabilities

As a user, you hold responsibility for any reasonable expenses or losses that Khronotech incurs stemming from third-party claims related to: (i) your use of any Game, (ii) your User Content, or (iii) your violation of these Terms. Should such a claim arise, Khronotech commits to making reasonable efforts to inform you of the claim as soon as we become aware of it.

Payment, Virtual Items, and Subscription Policies

Game Accessibility and In-Game Purchases:

Our Games are generally free to download and use. However, some Games may feature options for in-game purchases or subscriptions.

Payment for Virtual Items and Subscriptions:

When you initiate a purchase of a Virtual Item or a subscription within the Game, you request us to immediately supply the Virtual Item or subscription and begin processing the payment.
Payments are processed through your App Store account, subject to the payment terms of the platform. Khronotech is not involved in the transaction between you and the App Store.
For users in the EU or UK, by confirming your purchase, you acknowledge the waiver of your right to cancel the transaction once the supply of the Virtual Item or subscription begins.

Virtual Items:

You may earn, buy, or use Virtual Items within our Games. These Virtual Items are not your property; rather, they represent a limited, personal, non-transferable, non-sublicensable, and revocable license from Khronotech.
Virtual currency in your account does not equate to real-world currency. It merely indicates the extent of your license.
Khronotech reserves the right to manage, modify, or eliminate Virtual Items at any time, with prior notice provided through the Game where possible.
All purchases and redemptions of Virtual Items through the Game are final and non-refundable, as permitted by law. Termination of access or deletion of the Game results in the loss of Virtual Items without compensation, regardless of whether the loss of license was voluntary or involuntary.
Requesting the erasure of your personal data as per Khronotech's Privacy Policy will lead to the permanent loss of your Virtual Items, as they can no longer be associated with you.

Subscriptions:

Certain Games may offer subscription services, providing ongoing access to dynamic content or services. Subscription fees and durations will be detailed on the subscription page of the Game.
Subscriptions automatically renew unless terminated by you or us. You can terminate your subscription anytime via your App Store account settings.
To avoid being charged for the next subscription period, cancel at least 24 hours before the current period ends.
Subscription services purchased in a Game are billed by the App Store, and the store’s payment terms apply.

Cancellation and Refunds:

Subscriptions can be managed, including cancellation, through your account on the App Store, in compliance with the platform’s payment terms.
Current subscriptions cannot be canceled if already activated. Except as required by law, paid subscription fees are non-refundable.

Changes to Subscription Fees:

Khronotech may change subscription fees at any time, providing reasonable prior notice.
Should you decide to cancel your subscription due to a fee increase, you can do so via your account on the App Store.

Third-Party Relationships and Advertising

Application Stores:

Your access to our Games depends on the third-party Application Store from where you downloaded the Game, such as the Apple iPhone or Android stores.
The Terms outlined here are an agreement between you and Khronotech, not with the Application Store.
The Application Store and its subsidiaries are acknowledged as third-party beneficiaries of these Terms and have the right to enforce them.
The Application Store is not responsible for the Game itself, including its content, maintenance, support services, warranties, or any claims related to product liability, legal compliance, or intellectual property infringement.

Third-Party Services:

Khronotech is not accountable for, nor does it control, any Third-Party Services linked to or used in our Games.
These Third-Party Services are provided for your convenience, without any endorsement, approval, warranty, or representation by Khronotech.
You assume all risks associated with the use of Third-Party Services. We recommend conducting any necessary investigation before engaging in transactions related to Third-Party Services.

Advertisements:

Ads may appear when starting or stopping a Game, as well as during gameplay in various formats like banners, rewarded videos, or interstitial ads.
Our Privacy Policy provides details on the type of information shared with advertisers.

Please be aware that these third-party interactions are a part of the digital ecosystem of our Games and are necessary for maintaining the quality and continuity of our services.

Waiver and Release of Claims

In accordance with the limits allowed by applicable law, you irrevocably and unconditionally release and forever discharge Khronotech and its suppliers from any and all claims, demands, and rights of action, whether currently known or unknown. This release pertains to any interactions with, or actions or inactions of, any Third-Party Service, other users of the Games, or Third-Party Advertisers.

Specific Provision for California Residents:

If you are a resident of California, you expressly waive the provisions of California Civil Code Section 1542, which states: “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.”

This waiver and release is a fundamental part of the agreement between you and Khronotech, acknowledging the inherent risks and limitations of liability associated with digital services and third-party interactions within the scope of our Games.

Disclaimers

Games are provided "as is" and as available for your personal use on your device for entertainment purposes.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, Khronotech (AND ITS SUPPLIERS) EXPRESSLY DISCLAIM ANY WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT. Khronotech (AND ITS SUPPLIERS) MAKE NO WARRANTY THAT ANY GAME: (A) WILL MEET YOUR REQUIREMENTS; (B) WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS; OR (C) WILL BE ACCURATE, RELIABLE, COMPLETE, LEGAL, OR SAFE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

Liability Limitation Clause

Under the extent allowed by applicable law, Khronotech and its suppliers are not liable for any indirect, special, incidental, consequential, or punitive damages, or for any lost profits. This includes damages arising from your use of any Game or these Terms, regardless of whether Khronotech was informed about the possibility of such damages. Your access to and use of the Games are at your own risk, and you are solely responsible for any damage to your computer system, mobile device, or data loss that results from such use. The total liability of Khronotech for any claims under these Terms is limited to the amount you have paid to Khronotech in the 12 months preceding the claim. Khronotech’s suppliers bear no liability related to these Terms.

Regional Variations:

The exclusions and limitations of warranties, liabilities, or damages mentioned may not apply to you if you reside in states or countries where such exclusions are not permitted by law, including but not limited to New Jersey residents.
For users in the European Economic Area (EEA) or Brazil, these limitations do not apply. In these regions, Khronotech is liable for losses or damages that are a direct and foreseeable result of Khronotech’s breach of these Terms or negligence. However, we are not liable for unforeseeable losses or damages. A loss or damage is considered foreseeable if it is an obvious outcome of our breach or if it was contemplated at the time of agreement.

This clause outlines the scope of liability for Khronotech, setting expectations and limits on claims for damages arising from the use of our Games or the breach of these Terms.

Apple App Store Specific Provisions

For Games obtained through the Apple App Store, additional terms outlined here complement the general Terms of Service. Should there be any conflict or more restrictive clauses in this section compared to other parts of the agreement, these Apple-specific provisions take precedence, but only for Games sourced from the Apple Application Store.

Licensing Terms:

Your license to use any Game from the Apple App Store is a non-transferable right, allowing you to use the Game on iOS devices that you personally own or control, adhering to the Usage Rules specified in the Apple App Store Terms of Service.

Support and Maintenance:

The responsibility for providing support and maintenance services for the Game lies solely with Khronotech, as detailed in these Terms or as mandated by law.
Apple bears no responsibility for the maintenance or support of the Game.

Warranty Details:

All product warranties, either explicit or implied by law, fall under Khronotech's purview, except as effectively waived.
Should the Game not meet its warranted standards, you may report to Apple for a possible refund of the Game’s purchase price. Apple, however, carries no further warranty responsibilities for the Game.
Khronotech is solely accountable for all other claims, losses, liabilities, damages, costs, or expenses due to any warranty non-compliance.

User and Product Claims:

Any claims related to the Game, either by you or third parties, including product liability, legal or regulatory compliance issues, and consumer protection claims, are the responsibility of Khronotech, not Apple.
These Terms do not reduce Khronotech's liability beyond what is allowed by applicable law.

Intellectual Property Matters:

In case of any claims alleging that the Game or your usage of it violates third-party intellectual property rights, the responsibility for investigation, defense, settlement, and resolution lies with Khronotech, not Apple.

Compliance with Legal Standards:

You warrant that you are not in a country under a U.S. Government embargo or categorized as supporting terrorism, and you are not on any U.S. Government list of banned or restricted parties.

These Apple App Store specific terms ensure compliance with Apple's policies while clarifying the roles and responsibilities of Khronotech and Apple in the provision and use of the Games.

Essential Details of Terms of Service

Amendments to Terms:

We reserve the right to update, supplement, or eliminate parts of these Terms to stay aligned with legal mandates, optimal practices, or to introduce new functionalities. The latest modification date is indicated at this document's end.
We will notify you of significant changes through our website or directly within the Game.
By continuing to use the Games after such changes, you accept the updated Terms. If you do not agree with the modifications, you should cease using and uninstall the Game.
These changes are effective immediately upon posting. We recommend regularly reviewing these Terms, and you may want to keep a printed copy for your records.

Rights of Third Parties:

Only Application Stores, as specified in section 16, have enforceable rights under these Terms. No other third parties are entitled to enforce any terms here.

Severability Clause:

If any section of these Terms is found to be illegal or unenforceable, the rest of the Terms remain effective and enforceable.

Entirety of Agreement:

The Terms presented here are the complete and exclusive agreement between you and Khronotech concerning the Games, overriding all previous agreements.
Delay or failure on our part to enforce these Terms does not waive our rights to enforce them at a later time. You are still obliged to comply with these Terms, despite any delay in enforcement.

Transference of Rights:

You cannot transfer the Game or any Virtual Items for profit or otherwise. If selling a device with the Game installed, you must uninstall the Game. Transferring your rights under these Terms requires our explicit written agreement.
Khronotech retains the right to transfer our obligations and rights under these Terms to another organization. We will notify you in writing if this happens.

Jurisdiction and Governing Law:

These Terms are subject to English law and any legal proceedings should be brought to English courts. If you are located outside of England, legal proceedings must take place in a competent court within your location.
